Mom Sues Arlington Daycare After Kid Nearly Drowns
ARLINGTON (CBS 11 / TXA 21) ―
Her daughter nearly drowned in an Arlington water park. Now Kendra Jessie is suing her daughter's former daycare, saying she told staff her daughter couldn't swim.
Kyla Shellman is now an active and imaginative child, but she almost died one year ago on a field trip to B.K. Aquatic Center.
The Children's Palace Learning Center in Arlington is the daycare named in the suit and the subject of a thorough state review.
Officials with Child Protective Services say they found negligent supervision of little Kyla. The lawsuit also cites inadequate child-to-adult ratio at the park. There were about nine children for every adult, according to the document.
Jessie said she specifically told the day care that her daughter doesn't swim and isn't allowed near pools. Yet she consented to the field trip because she was lead to believe it was a "splash park."
Kyla reportedly fell into 12-feet of water and had to be rescued by a life guard. Now Jessie is suing the facility, wanting to make sure no other parent endures a similar traumatic experience.
"This needs to be exposed. People need to be aware of them breaking the rules and regulations," said Jessie. "She shouldn't have been there at all. The flyer they posted is misleading. It said 'splash park' - not aquatic center or pool."
The daycare center did not comment on the pending lawsuit.
