Travis County Offers Settlement To Tasered Granny
AUSTIN (AP) ―
A 72-year-old Texas woman whose Tasering by a deputy constable was shown on video nationwide has been offered a $40,000 settlement from Travis County.
Kathryn Winkfein, who was shocked with a stun gun after she dared the constable to do so during a May traffic stop, wants $135,000 for pain and suffering, medical expenses and humiliation. But county commissioners Tuesday approved $40,000 as their "firm" counteroffer.
Video from a camera mounted in the deputy's car showed Winkfein cursing and challenging the deputy and even daring him to use the Taser on her.
"You're going to shove me? You're going to shove a 72-year-old woman?" she yelled.
The incident is being reviewed by the district attorney's office, and a resisting-arrest charge is pending, said Precinct 3 Constable Richard McCain.
McCain says an internal investigation found no violations by the deputy constable.
Winkfein's lawyer Tom Tourtellotte said he would discuss the counteroffer with his client.
