Senator Still Fighting To Keep Opponent Off Ballot
FORT WORTH (AP) ―
A state senator will appeal a judge's ruling that a former Fort Worth city councilwoman is eligible to run against him in November, the lawmaker said Wednesday.
Republican state Sen. Kim Brimer filed a lawsuit earlier this month, claiming that Wendy Davis should be kicked off the ballot because she filed to run for the seat while still serving on the City Council.
In a statement Wednesday, Brimer also said he would agree to debate his Democratic opponent only if she is deemed eligible in the appellate process and if she repays the city of Fort Worth the portion of her $25,000 annual salary from her May 2007 re-election until January.
Brimer has said Davis should repay the money because when she ran for re-election, she never intended to serve the full council term. He also said she has used the money to fund her Senate campaign.
Davis resigned in August but remained on the council until her successor was deemed qualified in January.
But Davis' campaign manager Matt Latham said she does not intend to repay any money to the city because she was serving her council district during that time.
Responding to claims that Davis used her council earnings to fund her Senate campaign, Latham said Brimer must have been confused when he saw that Davis loaned her campaign $25,000 of her own money, a common practice among those running for office.
"Mr. Brimer still doesn't get it," Latham said in a statement. "Rather than try to win this election in the courts, Mr. Brimer should engage himself in an honest and public debate about issues important to the voters."
