Duncanville To Begin Citing Swingers Club Again

DUNCANVILLE (CBS 11 / TXA 21) ― The temporary cease fire between a swingers club and the City of Ducanville is over.

The city says it will once again issue citations to the Cherry Pit for throwing weekend swinger parties. The Cherry Pit operates in a residential neighborhood.

The attorney for the Cherry Pit tells CBS 11 that the club will fire back with a lawsuit next week. The suit will challenge the constitutionality of Duncanville's anti-sex club ordinance. The suit will also ask for a restraining order to prevent the city from issuing any more citations.

Officials with the City of Duncanville had previously stated there were three major problems with the club. Those issues include the size of the parties, which caused parking problems, the fact that the parties are advertised on a Web site and that guests are asked to make donations.

Last month the Cherry Pit offered concessions by removing "donations accepted" from its Web site and by securing off-site parking.
