DPD: No Charges Against Woman Who Hit Boy With SUV
DALLAS (CBS 11 / TXA 21) ―
A six-year-old child was hit and killed while riding his bike near a Dallas school Wednesday afternoon.
Dallas police say a driver of a Chevy SUV hit and killed Juan Rey Marin. The accident happened on Kingbridge Road near Edison Middle School. School had just let out.
The driver of the SUV was identified as a counselor at the middle school.
A police investigation reveals the driver was coming out of the school's parking lot when the boy turned in front of the vehicle. The driver was not able to stop in tmie.
"I came out and I saw a child hit by a car," said Brandi Rice, who witnessed the incident. "The mother was trying to hold him, comfort him. He just wasn't moving."
Juan was with his father at the time of the incident. The family said they believe the driver was inattentive.
"She was going 35 or 40 and talking on the phone," said Angelica Samudio, the boy's aunt. "The dad was yelling, "Stop! Stop!"
The child was taken from the scene to Children's Medical Hospital, where he was pronounced dead.
Juan attends Carr Elementary school and lives across the street from the middle school.
Superintendent Michael Hinojosa released a statement saying, "We're all devastated and broken-hearted by the tragic loss of one of our students."
"We looked at it, and there's no evidence the driver was speeding," said Dallas Police Sgt. Gil Cerda.
Police say the incident appears to be an accident, and no charges are expected to be filed. Despite being at the school, the driver was not in a school zone at the time.
