State Appeals Ruling In Polygamist Sect Case

SAN ANGELO (CBS 11 / TXA 21) ― Texas child welfare authorities have filed an appeal with the state Supreme Court, claiming an appellate court was wrong when it found they had no right to seize more than 440 children from a polygamist sect's ranch.

In its petition, filed Friday, the state claims the Third Court of Appeals made legal mistakes in its ruling, claiming "the Third Court offers a poor analysis of misstated facts."

In a separate filing, the state is also asking the Texas Supreme Court to allow it to keep custody of the children until the appeals are settled.  In the filing the state claims if it is forced to return the children to the custody of the adults at the ranch, "this would subject the children to continuing sexual and emotional abuse."

Members of the Fundamentalist Church of Jesus Christ of Latter Day Saints hailed Thursday's ruling as vindication. They've said there was no abuse at the ranch in west Texas and they are being persecuted for their religious beliefs.
