The attorney for a Duncanville house that throws swinger parties filed a motion in Municipal Court Thursday morning asking a judge to declare a city ban on sex clubs unconstitutional.
According to the attorney for the Cherry Pit, the municipal court judge in Duncanville is expected to issue his ruling the second week of July.
Duncanville recently strengthened its ordinance to designate any house or club that accepts donations for sexual activities as a sex club.
The owners of the Cherry Pit say donations are never solicited and that they are strictly voluntary.
The motion will be heard by Judge Kent Traylor Thursday morning at 9:00 a.m. at the Duncanville Municipal Court, located at 203 E. Wheatland Rd.
